The 64th Lecture of the BNU Legal Practice Lecture Series Themed "Practice and Challenges of Criminal Trial and Prosecution Work in Foreign-related Cases" Was Successfully Held

On May 30, the 64th lecture of the BNU Legal Practice Lecture Series themed "Practice and Challenges of Criminal Trial and Prosecution Work in Foreign-related Cases" was successfully held in Lecture Hall 1822, Rear Main Building of Beijing Normal University. The lecture was delivered by Prosecutor Zhuang Xiaoqian of the Chaoyang District People’s Procuratorate and Judge Li Mengjiao from the Chaoyang District People’s Court in Beijing. The event was moderated by Associate Professor Yang Chao from the Beijing Normal University Law School, with an enthusiastic group of law students from the Law School in attendance.




Associate Professor Yang, the host of the event, commenced by succinctly apprising the participating students of the two speakers' extensive frontline experience in foreign-related judicial matters. The lecture was poised to offer attendees an avant-garde insight into the practical aspects of handling foreign-related cases. Additionally, the two distinguished speakers, returning to their alma mater as proud alumni, engaged in vibrant and amicable interactions with younger students, fostering a spirit of camaraderie through their informative presentations.

Prosecutor Zhuang Xiaoqian first introduced the work of foreign-related criminal prosecution. At the beginning of the lecture, Prosecutor Zhuang played a promotional video - Chaoyang District Procuratorate's "Chaohui 3S" Foreign-related Procuratorial Work Brand. The video showcased the work orientation and value pursuit of safety, professionalism, and service of the Chaoyang District Procuratorate, leaving a deep impression on the students. Subsequently, Prosecutor Zhuang introduced the fruitful achievements and valuable experience of the specialized construction of foreign-related prosecution in Chaoyang District Procuratorate, and combined with laws and regulations such as the Criminal Law and Criminal Procedure Law, sorted out the relevant handling norms for foreign-related criminal cases. Subsequently, Prosecutor Zhuang introduced the handling of foreign-related cases by the Chaoyang District Procuratorate, pointed out the matters that need to be paid attention to in the process of consular investigation when handling foreign-related cases, and started with typical cases of foreign-related criminal cases that have been handled by the Chaoyang District Procuratorate. This not only aroused the strong interest of the students, but also deepened their understanding of the procuratorial work of foreign-related criminal cases.




Judge Li Mengjiao introduced the overview of Chaoyang District People's Court's handling of foreign-related criminal cases from a macro perspective, with the title of "Practice of Foreign-related Criminal Trials". At present, Chaoyang District People's Court has jurisdiction over foreign-related criminal cases in the four districts of Beijing, of which the majority are foreign crimes, mainly including drug cases and dangerous driving cases. Subsequently, Judge Li, from a micro perspective, introduced the special aspects of handling foreign-related criminal cases by comparing the process of ordinary criminal litigation cases. She elaborated on the process of handling foreign-related criminal cases from four stages: post acceptance, pre-trial preparation, trial, and post trial. Afterwards, Judge Li introduced the rich experience accumulated by Chaoyang District People's Court in foreign-related criminal trials from multiple aspects, and analyzed the existing problems and future improvement directions in foreign-related criminal trials based on practical work and typical cases.



In the Q&A segment, the participating students keenly directed their inquiries towards the impact of the foreign identity of the parties involved in foreign-related criminal cases, as well as the influence of the perception of the illegality of actions on the initiation of criminal proceedings. The two distinguished keynote speakers provided comprehensive and insightful responses grounded in practical experience, which facilitated the students' deeper comprehension of the professional nuances in the adjudication of foreign-related criminal cases, and enhanced their grasp of the procedural aspects of such cases.



As the lecture drew to a close, Associate Professor Yang Chao offered thoughtful commentary and a succinct summary, extending heartfelt thanks to the two keynote speakers. Amidst the appreciative applause from the students, this BNU Legal Practice Lecture concluded on a successful note.
